These terms apply to the purchase and use of Kurage Audio plugins, published by [NOM LÉGAL / LEGAL NAME] (GMLabs), Geneva, Switzerland. By buying or installing a plugin, you accept them, along with the privacy policy.
Payments are processed by Stripe, acting as merchant of record: the invoice, VAT and payment methods are handled by Stripe, whose terms apply to the purchase. Prices include taxes and are the same amount in Swiss francs, euros and US dollars. We never have access to your card details.
Each purchase gives you a personal, non-exclusive, perpetual licence for the plugin. It is issued in your name: your first name and initial ("Jane D.") are written into it. You may use it on up to 3 computers that you own or use. We take you at your word: nothing in the plugin counts or checks your computers.
The music you make with our plugins is entirely yours: you can use, release and sell it freely, royalty-free.
You may not resell, rent, lend or share your licence, nor distribute, circumvent, modify or decompile the plugin, except as expressly permitted by law. The plugin remains our property: you buy a right to use it.
After your purchase you receive your licence by email, as a block of text and as a .kurage file. Paste the text or drop the file into the plugin: it checks the licence on your computer, with no internet connection. The plugin never connects to the internet, neither for the licence nor for anything else.
Your account on kurageaudio.com, opened with your purchase email, lets you find your licences, download them, have them sent again, and change the name shown once.
Every plugin can be tried free for 30 days, fully featured and without an account. After that, the plugin keeps working but adds a short noise every 45 seconds until a licence is installed. It never locks you out: your projects and presets always load and save. Always try the trial before buying, to make sure the plugin works on your setup.
Updates within the same major version (for example 1.0 to 1.9) are free. The next major version (2.0) will be paid, and free if you bought the plugin less than 6 months before it comes out. We cannot guarantee compatibility with every future version of macOS or of your music software, but we do our best to maintain it.
After 6 months, you can give or sell your licence to someone else, free of charge, by writing to contact@kurageaudio.com. We issue a new licence to the new owner, and yours stops being valid.
Because it is checked on your computer, your licence stays valid for life, even if Kurage Audio stops trading and our service closes.
Try the trial before you buy: it is the full plugin. We refund a purchase when a technical problem prevents you from using the plugin and we cannot solve it: write to contact@kurageaudio.com with your receipt. Stripe, as merchant of record, may also grant a refund under its own rules, in particular within the statutory withdrawal periods that apply to you.
A refunded, disputed or transferred licence is added to a list built into the following versions of the plugin, which no longer accept it.
THE PLUGINS ARE PROVIDED "AS IS". TO THE EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES NOT STATED IN THESE TERMS, INCLUDING ANY WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE. Keep backups of your projects. OUR LIABILITY IS LIMITED TO THE PRICE YOU PAID FOR THE PLUGIN CONCERNED, EXCEPT FOR WILFUL MISCONDUCT OR GROSS NEGLIGENCE. WE ARE NOT LIABLE FOR INDIRECT DAMAGES (LOSS OF DATA, PROJECTS OR REVENUE).
We send you the emails your purchase requires: licence, sign-in links, important information about your plugin. We only send news or offers if you agreed to it, and you can unsubscribe in one click.
These terms may change. A change never reduces the rights attached to a licence you have already bought.
These terms are governed by Swiss law, with jurisdiction in Geneva. If you are a consumer, you keep the protection of the mandatory rules of your country of residence. They exist in French, English and German; in case of discrepancy, the French version prevails.
